The court did not remove the prosecutor in the criminal case against former parliamentarian Kristijonas Bartoševičius

2024-11-27

On Friday, Panevėžys Regional Court ruled that prosecutor Donatas Skrebiškis will continue to represent the state's accusation in the criminal case against former member of Parliament Kristijonas Bartoševičius.

The defense attorney for the accused, K. Bartoševičius, had requested the removal of the state prosecutor during the previous hearing. The attorney justified this request by stating that due to certain circumstances revealed in court, related to the actions of the parties involved in the process, it would be appropriate to question the prosecutor as a witness, and therefore, he should be removed.

If the prosecutor were to acquire the status of a witness, he would no longer be able to represent the state's accusation in this case.

Having examined the arguments in the motion for removal, the court concluded that the reasons for removal cited by the defense attorney were unfounded, and such questioning of the prosecutor as a witness would be inappropriate. The court noted that the prosecutor has no personal interest in this case, only a procedural one, and therefore rejected the motion for removal.

The court's decision regarding removal is final and is not subject to appeal.

Former parliamentarian K. Bartoševičius is accused of sexual assault, sexual coercion of a person under the age of sixteen, and causing non-serious bodily harm.

In the next hearing, scheduled for December 4, it is planned to question four experts who provided psychiatric-psychological expert opinions of the underage victims during the pre-trial investigation.
