Regional Court Upholds Prison Sentences for Alcohol Thieves in Panevėžys

The Panevėžys Regional Court upheld the four-month prison sentences imposed by the court of first instance on two residents of the Jonava district and Kaunas who misappropriated luxury alcoholic beverages from stores in Panevėžys.

The court established that R. D., who has 16 prior convictions, and A. Š., who has 37, stole alcoholic beverages with a total value of €965.90 from two "IKI Lietuva" stores located in Panevėžys.

The thefts were committed in December 2024, when expensive alcoholic beverages such as "Martell Cognac VS," "Don Papa Rum," "Hennessy," "Moët&Chandon Champagne," "Piper Heidsieck Cuvee Brut Champagne," etc., were stolen from two different "IKI" stores within a few hours.

For these crimes, R. D. and A. Š. were sentenced to imprisonment, and €965.90 was awarded to the private limited liability company "IKI Lietuva." Both convicts were recognized as recidivists.

In his appeal, R. D. requested not to be recognized as a recidivist and to be given a more lenient sentence, citing his confession and remorse. A. Š. requested that the prison sentence be replaced by arrest or community service, stating that he is being treated for drug addiction, visits specialists, and the imposed prison sentence would interfere with his treatment.

However, after examining the case, the regional court concluded that "the imposed sentences were properly individualized and there is no reason to change them to more lenient ones based on the motives stated in the appeals."

The regional court rejected R. D.'s request not to be recognized as a recidivist, stating that the recognition of both convicts as recidivists was properly motivated, given that both convicts had been convicted many times for systematically committed intentional criminal acts.

A. Š.'s request to change the sentence due to addiction treatment was also rejected. The court noted that the convict would have the opportunity to participate in addiction prevention activities in the place of imprisonment. Furthermore, according to the Code of Execution of Sentences, healthcare services, including necessary services, are provided to persons serving a prison sentence in accordance with the established procedure, both in the hospital of the place of imprisonment and in other personal healthcare institutions.

The ruling of the Panevėžys Regional Court is final and not subject to appeal.
